Did New Bedford Mayor Jon Mitchell Violate The 1993 Education Reform Act When He Personally Contacted Mass. Education Commissioner Chester Mitchcell on New Bedford District Turn Around Plan?
Mayor Mitchell is only one (1) vote on New Bedford's Elected School Committee.
Mayor Mitchell cannot use his Mayor's Position to speak for the other six (6) Elected Members of New Bedford's School Committee,, especially when this matter was never discussed by the Elected School Committee as an Agenda Item, or voted upon by the remaining six (6) Members of New Bedford's Elected School Committee.
The Minutes and Public Records will officially note and verify, that no such vote, or School Committee Agenda Item was approved by New Bedford's Elected School Committee. Who gaveMayor Mitchell's Authorization to have official discussions with Massaachusetts Education Commissioner Chester?
Surley as an Attorney, and former United States Asst. Attorney, Mayor Mitchell cannot claim "IGNORANCE OF LAWS", of the Commonwealth of Massachusetts, or the Laws of the United States, or Ignorance of the Massachusetts Dept. of Education , Rules and Regulations" or the Required "Rules of Procedure" govering New Bedford's Elected School Committee.
Pursuant to the 1993 Education Reform Act, the Act does not give Mayor Mitchell or the Elected School Committee collectively, the authority to make this kind of deal/arrangement with Commissioner Chester Mitchell, the Commissioner for the Massachusetts Department of Education.
As New Bedford Turn Around Plan had been completed for over a week now, and is due to the State Board of Education on April 2, 2012, there are no reasons whatsoever, Lawful or otherwise, that Dr. Francis and New Bedford School Administration should not submit the District's Turn Around Plan, no matter how Mayor Mitchell has been deceptive and dishonset, with the Press, School Committee, Teachers and Public.
Supertindent Francis did not request, neither does the School Administration request any additional time for the District Turn Around Plan to be submitted.
The obvious question for the Press/Media, to ask of Commissioner Mitchel Chester and New Bedford Mayor Jon Mitchell, is if and the date that Massachusetts Department of Education, "Offically Notify" the Superintendent of New Bedford District, of a New Plan Date and the written reasons for this delay, as the District did not request this extention of time and the Plan is ready for submission.
Superintendent Francis does not need additional time, and neither has there been any official School Committee "VOTE", requesting Additional time for submittal.
The date of submital of the District Turnaround Plan is not Mayor Jon Mitchell's or the Collective School Committee's call.
The 1993 Massachusetts Educational Reform Act, gives that exclusive call to the Superintendent of Schools and School Administration only.
If Mayor Mitchell and Commissioner of Education Chester Mitchell do not know this, then I am sure there will be consequences, for their "INTENTIONAL and DELIBERATE" Unlawful and Illegal Acts.
It's clear now, based on this editorial and others, that bob unger is the true power in the city. Unger speaks and Mitchell jumps. Bob can simply dictate who he wants to run our city schools. Just Imagine bob's outrage if does get his way. After all the standard times knows what's best for our city.
Let's fire Mitchell in 2 years. He's doing nothing to bring down the crime rate. We'll be known for murders and robberies. Who will Mitchell blame in 2 years?
Plan is ready for submission. Plan is actually underway since October, but that's another story. Plan does not require an extension. In fact, extension puts Boston consultants and plan writers into confusion. And yet, the Unger board says this "strengthens NB position"? Because Cheter allowing FFP a new deadline means ESE is "in no hurry" to take over the schools? IF this was any other mayor, or any other editorial board, this would be decried as an unprecedented act of Mayoral overreach that makes a laughingstock of the School Committee, shows ESE that New Bedford is incoherent, and is a possible violation of the spirit and purpose of Ed Reform 1993 and the open meeting laws.
Aren't there other departments in the City that need some work/help? Why is the mayor focusing his attention on the schools? Follow the trail.... you will find out who's in control...

This standard times editorial is a bunch of B.S. It's seems obvious to me they're in on the conspiracy against Dr. Francis.

The FFP has done NOTHING for the city so far except create a MESS!!!
